The Sardinas Find A Charity Forum aka “Tropa de Esperanza” (the “Forum”) is dedicated to a) committing its personal time, skills, and energy to assisting various and varied local charities (the “Charity”) and b) providing a platform to identify and recruit local like-minded selfless people to stand side-by-side with the Forum and its members in doing the same. The Forum is not acting as charity itself, we are not raising funds, and your willingness to take advantage of our platform will not, in and of itself, provide you with a tax benefit or other community service credit. We offer you an opportunity and are only asking for a commitment of your time, skills, and energy, as we together help our local charitable organizations accomplish their respective goals.
Upon your signature below and your participation in the respective Charity activities, you hereby acknowledge and agree that:
- your efforts and contributions are being directed to the Charity, not the Forum, your decision to volunteer your time and efforts is entirely voluntary, you will not be compensated in any way by the Forum or the Charity, and your efforts and contributions will be provided at no cost.
- you acknowledge and agree that your efforts on behalf of the Charity may involve physical or strenuous activities, with a potential risk of injury and you warrant and represent that you are and will remain at all times physically and emotionally able to undertake such activities.
- you are voluntarily and knowingly assuming any and all risks associated with your efforts and contributions to the Charity, including the risk of injury and acknowledge that no conditions, assurances, representations, or warranties of any kind have been provided to you by the Charity or the Forum regarding your fitness and physical ability to perform the activities or with respect to the safety or adequacy of the surroundings or any equipment provided by or to you
- you not sue or make any claim of any kind whatsoever against the Forum, the Charity or any of their sub-contractors, employees, agents, representatives, or designees (the “Released Parties”) arising from, which occurred during, or was caused as a result of your acts, efforts, or contributions to the Charity.
- you and your heirs, next of kin, spouse, guardians, legal representatives, executors, administrators, successors, and assigns unconditionally and irrevocably release, discharge and hold harmless the Released Parties to the fullest extent permissible under any law from any and all manner of liabilities, claims, obligations, actions, proceedings, damages, costs, and judgments of any kind or nature whatsoever, in law or equity, whether known or unknown, and whether at your instance or at the instance of any third party, related to any harm, loss, physical or mental injury, physical or mental illness, emotional distress, death, disability, disfigurement, or damage to person or property that you or any third party may suffer arising out of or related to your participation with the Charity.
- you indemnify and hold harmless the Released Parties in respect of any loss or damage incurred by you and those claiming on your behalf by reason of your participation with the Charity.
- you grant the Forum and the Charity the limited right to use your name, likeness, photograph, or image solely for promotional purposes (and not for commercial gain or exploitation).
- activities are not related in any way to Univision Communications, Inc., or its subsidiaries, affiliates, agents or licensees.
By accepting this agreement, you agree that you voluntarily participated in the chosen activities and assume all risks associated with contributing time and efforts to the Charity.
For such contributions and efforts, on behalf of the Forum and the Charity, we sincerely thank you.
